Terms and Conditions for Traube

Welcome to Traube Club ("Traube," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Traube website at https://traube.club and any related applications, features, or services (collectively, the "Service"). By creating an account, responding to an invite, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About Traube
Traube helps friends coordinate gatherings by creating, sharing, and managing events. The Service provides tools for building event pages, inviting participants, tracking RSVPs, coordinating logistics, and messaging attendees. We may add or remove features from time to time.

2. Eligibility and Accounts
You must be at least 13 years old and capable of entering into a binding agreement to use the Service. When you register you must provide accurate information, keep your credentials secure, and notify us immediately at hi@traube.club of any unauthorized use. You are responsible for activities that occur under your account.

3. User Content and Conduct
You retain ownership of the content you submit, including event details, messages, photos, or other materials ("User Content"). By submitting User Content you grant Traube a worldwide, non-exclusive, royalty-free license to host, display, and otherwise use it to operate the Service. You represent that you have the necessary rights to share User Content and that it does not infringe, violate, or misappropriate any third-party rights. You agree not to post content that is unlawful, abusive, hateful, pornographic, or otherwise objectionable, and not to use the Service to send spam, interfere with others, or attempt to reverse engineer the Service.

4. Invitations and Communications
Traube allows you to send invites, reminders, and other communications to friends. You must only send communications to people who have consented to receive them, and you are responsible for the information you share about your contacts. We may send you administrative, transactional, and marketing communications consistent with our Privacy Policy; you can opt out of non-essential emails in your account settings.

5. Paid Features and Refunds
Traube may offer optional paid plans or add-ons. Fees, billing cycles, and plan-specific terms will be shown at purchase. Unless otherwise stated, charges are non-refundable except where required by law or where we provide a written refund policy. We reserve the right to change pricing with reasonable notice; any change will apply in the next billing period.

6. Intellectual Property
The Service, including our content, logos, trademarks, and software, is owned by Traube or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless we provide written permission.

7. Third-Party Services
We rely on trusted vendors to deliver the Service, including Supabase for authentication and data storage, Resend for email delivery, and other integrations you choose to connect. Your use of third-party services is governed by their own terms, and we are not responsible for their actions.

8. Privacy
Our collection and use of personal data is described in the Privacy Policy located at https://traube.club/privacy-policy. By using the Service you consent to our data practices.

9. Termination
You may stop using the Service at any time. We may suspend or terminate your account, remove content, or restrict access if you violate these Terms, create risk or legal exposure for us, or for other legitimate reasons. On termination, sections that by their nature should survive will continue to apply, including ownership, disclaimers, limitations of liability, and governing law.

10. Disclaimer of Warranties
The Service is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability
To the fullest extent permitted by law, Traube and our officers, employees, partners, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any conduct or content of other users; or (c) unauthorized access, use, or alteration of your transmissions or content. Our aggregate liability for all claims relating to the Service is limited to the greater of $100 USD or the amounts you paid us in the 12 months preceding the event giving rise to the claim.

12. Indemnification
You agree to indemnify, defend, and hold harmless Traube and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.

13. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, for any dispute arising from these Terms or the Service.

14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
